1. Scope of Application

1.1 These General Terms and Conditions (GTC) of DS Trade GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods (cannabis seeds) concluded by a consumer or entrepreneur ("Customer") with the Seller via the online shop.
1.2 Deviating conditions of the customer are not recognized unless they are expressly agreed in writing.

2. Conclusion of Contract

2.1 The products presented in the online shop are non-binding and do not constitute a legally binding offer.
2.2 By submitting an order, the customer makes a binding offer to conclude a contract.
2.3 The contract is concluded when the seller accepts the offer by confirming the order or by delivering the goods.
2.4 The contract text will be sent to the customer by e-mail after the order is placed.

3. Right of Withdrawal

3.1 Consumers generally have a right of withdrawal in accordance with the statutory provisions. Details can be found in the separate withdrawal instruction.

4. Prices and Payment Terms

4.1 All prices are total prices including statutory VAT.
4.2 The available payment methods are shown in the online shop.
4.3 The purchase price is due immediately upon conclusion of the contract.

5. Delivery and Shipping Conditions

5.1 Delivery is made to the address specified during the order process.
5.2 Shipping costs are displayed separately before the order is completed.
5.3 If delivery fails for reasons attributable to the customer, the customer shall bear the resulting additional costs.

6. Retention of Title

The delivered goods remain the property of the seller until full payment has been made.

7.Liability for Defects (Warranty)

7.1 The statutory warranty regulations apply.
7.2 Seeds are natural products — no guarantee can be given for germination, growth, or yield.

8. Redemption of Promotional Vouchers

The conditions stated on the respective voucher apply.

9. Redemption of Gift Vouchers

Gift vouchers can only be redeemed for the purchase of goods in the online shop.

10. Applicable Law

The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11. Jurisdiction

For contracts with entrepreneurs, the seller’s place of business is the place of jurisdiction.

12. Code of Conduct

The seller complies with industry-standard codes of conduct, particularly regarding the protection of minors.

13. Alternative Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
The seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

14. Notes on Cannabis Seeds / Legal Notice

14.1 The sale is exclusively for commercial, collector, or souvenir purposes. Germination, cultivation, or growing is prohibited in many countries.
14.2 The purchase and possession of hemp seeds is generally legal in Austria — however, their cultivation and manufacture of narcotics from hemp is prohibited under the Narcotic Substances Act unless a corresponding official permit is in place.
14.3 The seller assumes no liability whatsoever for the misuse of the seeds offered. The customer is responsible for informing themselves about the legal provisions in their country and complying with them.
14.4 Sale only to persons aged 18 and over.
